Q: The Listing Agent told me they represent the seller,
but said they will be fair to me. Do I really need my own agent in this case?


A: Of course all agents should be fair and respectful to the buyer and the seller. But, the listing/seller agent is bound by the Real Estate Law of Agency, to represent the seller. The listing/seller agent MUST work and negotiate in the best interest of the seller. The seller has representation, shouldn't you? A Buyer agent works and negotiates in the best interest of the buyer.



Q. How does a Buyer Agent establish a contractual relationship to
represent me?

A:
By a written contract. Just as sellers establish a contractual relationship by signing a listing agreement with their agent, you establish a contractual relationship with a buyer agent by signing a buyer's agency agreement. This agreement makes the buyer agent legally accountable to you and not to any seller.




Q. Does a Buyer Agent have access to all resources of a Listing Agent?

A: Yes! A buyer agent can also show you homes that are "for sale by owner."



Q. What if I am not able to find a home that meets my needs?

A: You can terminate your contract with buyer agent. Typically buyer agents are only compensated by means of the proceeds from the transaction.




Q. Isn't the agent who shows me homes representing me?

A: Not unless you have a written Agency Agreement that specifically says so. The agents who lists a property normally enter into a signed contract with the sellers to represent them in the sale of their property. This same contract may permit the listing agent to serve as a Dual-Agent. Unless you have a written Agency Agreement with a real estate agent promising to represent only YOUR best interest, you may find yourself working with an agent who is obligated to act in the best interests of the seller.



Q. Doesn't it cost me more to use a Buyer Agent, since they work on
commission? Why would they try to get a lower purchase
price for a house?


A: Buyer agents are bound my law to work in your best interest not their own. They are interested and need long term relationships to be successful. No it will not cost you more to use a Buyer Agent. It often costs you less.



Q. I'm moving to another city. How do I find a reputable Buyer Agent
at my new location?

Q. What is exclusive buyer representation and how did it develop?

A: In 1983, a Federal Trade Commission study revealed that over 72% of all home buyers nationwide mistakenly believed they were being represented by the agent who was showing them homes. As a result, laws requiring agents to disclose exactly who they represent have been passed all over the country. When consumers became aware that most agents worked for the seller, they began demanding their own representation. In response, Buyer Agents began offering buyer representation to home buyers.



Q. How is a Buyer Agent paid for their services?

A: The most common way is the same way other real estate agents are paid, typically commission paid at closing is usually divided between the listing broker and broker of the Buyer Agent. THERE IS NO NEED FOR YOU TO INCUR ADDITIONAL COSTS FOR A BUYER AGENT'S SERVICES.



Q. Does Buyer Agency help me legally?

A: Yes it does. Responsibility and accountability to a client are two legal requirements of agency representation. Buyer Agents negotiate in the best interests of the buyer, and do not disclose confidential information about the buyer, and reveal all facts affecting the value of properties to the buyer.
